TERMS OF SERVICE

By commissioning me (SerenRibbity), you (the client) are stating you have read, understood, and consent to the terms of service below.If these terms are violated, service will be immediately terminated will not be continued in the future.

1. General Terms

  • All work is digital and will not be shipped.

  • Tight deadlines will not be accepted due to my health and IRL schedule. Each commission's turnaround time will be different based on their details.

  • Work will be sent via a Google Drive folder with the finished piece/assets (depending on the type of commission). It is HIGHLY recommended to save the assets and reupload them to your own cloud, computer, etc. for safe keeping.

  • I will not draw:

  • NSFW

  • IRL People

  • Hateful/Harmful Imagery

  • I reserve the right to decline any commission that I feel may violate these terms.

  • Under no circumstances do I permit my work to be used in markets that make use of blockchain technology. This includes any form of cryptocurrency (such as Bitcoin or Lifecoin) and non-fungible tokens (NFTs).


2. Payment and Pricing

  • Payment (USD) must be made upfront.

  • A down payment minimum of 50% will be allowed if the commission is over 100 USD, but must be paid in full before the final piece is sent.

  • 50% payment must be made to secure a VTuber Slot, and the other half must be paid before receiving it.

  • Invoices will be sent via PayPal once the details of the commission are confirmed. This invoice will include a copy of the T.o.S., as well as a list of what the commission entails.

  • The final price may be adjusting depending on the complexity of said commission (such as complicated armor, backgrounds, etc.) at my discretion.


3. Refunds

  • No refunds may be sent for any commission that is already completed.

  • Only a partial refund will be allowed if a commission is currently in the works, and the percent is entirely dependent on the state of completion for said commission.



4. Copyright and Usage Policy (Commercial Projects)

  • I classify a project to be commercial when the client has the intent to monetize the commission piece. This includes selling merchandise, using the piece in advertising, and using the piece as a stream asset.

  • Please inform me in advance for what commercial purpose you will be using my work for.

  • If you are reselling a Live2d model that I worked on, I will appreciate it if you sell it for lower than the overall commission price. I can't enforce this as you technically own the rights, but it would still be greatly appreciated if you consider this.

  • Character illustrations are priced for personal use only; if you wish to retain commercial rights you will need to pay 3x the base, non-commercial cost.

  • You are not allowed to claim the piece as your own work. Please leave a credit to me and a link to this page in some manner or I will respond with the appropriate actions.


5. Copyright and Usage Policy (Non-Commercial Projects)

  • I classify a project to be personal when the client has no intent to make money through the use of the piece. This includes hobbyist purposes (such as for use in TTRPG campaigns) and printing the piece for personal display.

  • I retain all the rights to the completed piece. Including distribution.

  • You will retain the rights to your characters if they are yours.

  • You are not allowed to use the piece for commercial purposes. This includes use in merchandise, use in published work, or any function that monetizes the commission.

  • You are not allowed to claim the piece as your own work.

  • You are not allowed to alter my work in any way.

  • If you are a streamer who doesn't intend to make sizable income through your stream, you may ask to have your project be classified as personal. If you change your mind down the line and wish to make income through streaming after you commissioned me, I will expect you to buy the commercial rights to the piece.

  • If you wish to buy the commercial rights to a piece which was previously classified as a personal project, you only need to pay the difference between the personal and commercial pricing.

This is a quick illustrated guide for the rigger of your choice. This will aid them with keeping the style of the art intact while rigging.

Q. What are expression guides?

A. Similar to face angle guides, these are illustrations (NOT ASSETS) that are used as a guide to better help the rigger of your choice when it comes to setting up models. As I am not a rigger, I cannot create these expressions (unless it is the face you want the default to be) I can only set them up to be rigged.
